GASPA MACCHINE is a dealership specializing in the sale of new and used agricultural and construction machinery (tractors, mini-excavators, wheel loaders, tandem rollers, telescopic handlers, and accessory equipment). Every listing published on our website gaspa-macchine.com and on any associated advertising platform displays the actual technical characteristics of the machine offered for sale.
This page clearly and thoroughly explains:
- how we collect, verify, and publish the technical specifications of each machine;
- which differences are normal and acceptable between catalog data and the delivered machine;
- which technical documents accompany each machine at the time of delivery;
- what to do if the machine received does not match what was described in the listing.
This policy applies to all orders placed on our website and to shipments to Italy, Austria, Finland, France, Germany, the Netherlands, Poland, Romania, Spain, and Switzerland, and is complementary to our Warranty and Protection Policy, which governs the consumer's legal rights of conformity.
Please Note: the term "technical specifications" includes, by way of example but not limited to: make, model, year of registration or manufacture, engine type and power, operating hours recorded on the hour meter, dimensions and operating weight, load capacity, transmission type, equipment and accessories, emission level, and homologation category.
GASPA MACCHINE is committed to ensuring that every piece of technical information published in its listings, on its website, and on any advertising channel is accurate, up-to-date, and verifiable at the time of publication. We never publish generic technical specifications, copied from other listings, or not corresponding to the machine actually available for sale.
- The model, year, and make indicated correspond to the machine physically present in our warehouse or in the supplier's availability at the time the listing is published.
- Data relating to engine, power, displacement, transmission, and capacity are taken from the manufacturer's original technical documentation or directly measured on the machine.
- The operating hours indicated for used machines correspond to the value read on the hour meter at the time of inspection, with indication of the date of reading.
- The accessories, attachments, and equipment listed in the advertisement are actually included in the sale, unless explicitly stated otherwise.
- Any defects, damage, modifications, or non-original components detected during inspection are declared in the listing or communicated before the order is completed.
- We do not use images, technical data sheets, or descriptions relating to a model different from the one actually for sale.
- We do not omit relevant information about known defects, significant repairs, or usage limitations of the machine.
- We do not indicate power, capacity, or performance higher than those actually certified or declared by the original manufacturer.
- We do not present used machines as new, nor reconditioned machines without clearly indicating their condition.
Continuous updating: if a machine is sold, damaged, or replaced with a unit of different characteristics before the listing is removed, we commit to updating or deactivating the listing as soon as possible to avoid information not corresponding to actual availability.
To ensure maximum transparency, we indicate here the sources used to prepare the technical data sheets of products published on our website.
For new machines, the published technical specifications are derived directly from the manufacturer's official documentation (technical catalogs, user and maintenance manuals, EC declarations of conformity, and product data sheets provided by the manufacturer or authorized distributor). We never modify the values declared by the manufacturer without notification.
For used machines, each unit is personally inspected by our technical team before the listing is published. During the inspection, the following are recorded: serial/chassis number, hours registered on the hour meter, general condition of the bodywork and mechanical components, presence of any non-original parts, and operation of hydraulic, electrical, and safety systems. The values thus recorded are reported in the listing together with the date of inspection.
The photographs published for used machines are actual images of the specific machine for sale, taken at our warehouse or at the supplier's site. For new machines not yet physically available, official manufacturer images relating to the same model, color, and configuration may be used; in such cases we clearly specify this in the listing (see Section 7).
Traceability: for each used machine we maintain an internal inspection sheet, dated and archived, which can be provided upon request to a customer who has initiated a complaint for technical discrepancy (see Section 11).
For each new machine offered for sale, we guarantee the correspondence of the following data with the manufacturer's official documentation:

If the manufacturer updates the specifications of a model after our listing is published (for example, due to production changes), we commit to updating the listing as soon as we receive official notification and, in any case, before delivery to the customer (see Section 10).
Used machines represent a significant part of our catalog. For this product category, transparency about the condition of use is a central element of our policy.
The operating hours value indicated in the listing corresponds to the hour meter reading recorded at the time of pre-sale inspection, with indication of the relevant date. Since the machine may remain on display or in storage for a certain period before shipment, the hour meter may show a slightly higher number of hours at the time of delivery, due to movements, functional tests, loading/unloading, and internal transport. This possible difference:
- does not entail any change to the agreed price;
- is communicated to the customer upon request, indicating the value recorded at delivery;
- is not considered a technical discrepancy under Section 11, unless the difference is manifestly anomalous (exceeding 20 hours) relative to the period between inspection and delivery.
For each used machine we indicate in the listing the general condition of bodywork, tires/tracks, hydraulic system, electrical system, and cab, using clear descriptions (for example, "good general condition with normal signs of use," "tires at 60% wear," "presence of small dents on left side hood"). Any structural damage, known oil leaks, partial malfunctions, or non-original components are expressly declared.
When available, we indicate the number of previous owners, the main sector of use (agricultural, construction, municipal), and the possible availability of maintenance documentation (service booklets, repair invoices). Machines sold "as-is": for some particularly old used machines or those intended for parts, the listing may specify the formula "sold as-is." In such cases, warranty conditions are limited as described on the page Disclaimer on Used Equipment Sold As-Is, without prejudice to the minimum mandatory rights provided by law for consumers.
Agricultural and construction machinery are industrial products subject to normal manufacturing tolerances. For this reason, some numerical values reported in technical data sheets may show small variations compared to the exact value of the individual unit, without this constituting a discrepancy or misleading information.
- Operating weight: variation up to ±5% compared to catalog data, due to trim configuration, mounted accessories, or fluid levels.
- Dimensions (length, width, height): variation up to ±2 cm, due to assembly tolerances or type of tires/tracks installed.
- Engine power: the indicated value refers to the nominal power declared by the manufacturer under standard test conditions; actual power may vary depending on environmental conditions, maintenance, and engine wear.
- Color: for new machines, the color of the delivered machine corresponds to the manufacturer's official livery for that model, which may show slight chromatic variations between different production batches.
- Differences in model, engine (e.g., different displacement or number of cylinders), or drive compared to what was described.
- Absence of accessories or equipment expressly listed as included in the listing.
- Engine emission category different from that declared.
- Year of registration or production different from that indicated.
In the presence of one of the situations listed as "not acceptable," the customer has the right to activate the procedure described in Section 11.
The images and videos published with each listing are designed to offer the customer a faithful representation of the machine for sale.
All photographs relating to used machines are actual images of the specific unit that is the subject of the listing, taken during pre-sale inspection. The images show the actual condition of the machine, including any signs of wear, dents, or non-original components, consistent with the textual description of the listing.
For new machines not yet physically available at our warehouse, we may use official manufacturer images relating to the same model, the same version, and, where possible, the same color and accessory configuration. In these cases, the listing includes a clear statement such as "image for illustrative purposes – the machine actually delivered corresponds to the indicated technical specifications." Any minor aesthetic differences (e.g., stickers, dealer logos, optional accessories not standard) are reported separately.
We commit to publishing high-resolution images, not digitally altered in substantial content (shape, components, visible damage). Small variations in perceived color may result from lighting conditions at the time of shooting or from the buyer's screen settings, and do not constitute a discrepancy from the description.
Operational videos: for many used machines we publish, where available, a short video showing the start-up and operation of the main mechanical components (engine, lift, tracks/wheels). This material is available upon request also for machines not yet published online.
Each machine sold by GASPA MACCHINE is delivered, where applicable and available, with the following technical documentation:
- User and maintenance manual from the manufacturer, in the original language or, if available, in the language of the destination country.
- EU Declaration of Conformity (CE marking), for new machines falling within the scope of Machinery Directive 2006/42/EC.
- Registration documents or vehicle registration certificate, for used machines equipped with them according to the regulations of the country of first registration.
- Customs and transport documentation, for intra-Community and extra-EU shipments (see the page Customs, Duties, and Import Regulations).
- Testing report and pre-delivery inspection, as described on the page Equipment Testing and Pre-Delivery Inspection.
- Maintenance history, when available from the previous owner, according to the page Equipment Maintenance History and Documentation.
Documents not available: for some used machines of foreign origin or old production, some original documents (e.g., paper manual or original purchase booklet) may no longer be available. In these cases we specify this in the listing before purchase, and provide, where possible, equivalent digital copies obtained through the manufacturer or its official channels.
Agricultural and construction machinery are subject to technical, homologation, and registration regulations that may vary from country to country. We indicate below the main information for each market to which we ship, to allow the buyer to correctly assess the necessary requirements in their own country.
For all countries of the European Union and for Switzerland (which applies equivalent standards through bilateral agreements), new non-road machines must comply with Stage V emission limits. We always indicate the engine emission class in the technical data sheet. For used machines, registered or put into service prior to the entry into force of such limits, we indicate the original emission class at the time of first registration, without any declaration of conformity to subsequent standards not possessed by the machine.
Some machines (for example, agricultural tractors and telescopic handlers) may circulate on public roads within the limits provided by the Italian Highway Code (Legislative Decree 285/1992) and the equivalent national regulations of destination countries. The buyer is responsible for carrying out, with the competent authorities of their own country, the formalities of new registration, re-registration, or national homologation possibly required for use on public roads. GASPA MACCHINE provides all technical documentation in its possession to facilitate such procedures, but does not guarantee timelines or outcomes of local administrative procedures, which depend on the authorities of each country.

Communication to Orders in Progress
If a customer has already placed an order before the update, we inform them of the change before delivery, offering the possibility to confirm the order under the new conditions or to withdraw without penalties, if the change is substantial.
Non-substantial modifications: small variations (for example, updating the manufacturer's logo, a new software version of the control unit that does not modify performance, or a minor change in the color range) do not necessarily entail suspension of the order, but are still communicated upon customer request.
If, upon delivery, you find that one or more technical characteristics of the machine do not correspond to what was indicated in the listing at the time of order (excluding the tolerances described in Section 6), you may activate the verification procedure described below.

Write to info@gaspa-macchine.com indicating the order number, the non-corresponding technical characteristic, and, if possible, photographs or videos of the identification plate, hour meter, or component in question.

Internal Verification
Our technical team compares the listing documentation, the pre-sale inspection sheet, and the material provided by the customer, and responds within 5 business days.

Outcome Favorable to the Customer
If the verification confirms a discrepancy not attributable to an acceptable tolerance, we offer, at the customer's choice: price adjustment in proportion to the difference found, replacement of the machine with a unit conforming to the description (if available), or termination of the contract with full refund, including return shipping costs, according to the procedures indicated in our Returns and Refunds Policy.

Outcome of Acceptable Tolerance
If the difference falls within the margins described in Section 6, we explain in detail the technical reason, providing the manufacturer's reference documentation.
Independence from legal warranty: the procedure described in this section concerns the correspondence between the advertised specifications and the delivered machine, and is independent and complementary to the legal conformity warranty rights described in our Warranty and Protection Policy, which remain fully applicable.
Nothing in this Technical Specifications Warranty limits the mandatory rights provided by law for consumer protection in their country of residence, including rights relating to the legal warranty of conformity (EU Directive 2019/771) and protection against unfair and misleading commercial practices (EU Directive 2005/29/EC, implemented in Italy by Legislative Decree 146/2007 and Article 21 of the Consumer Code).
In case of dispute relating to the technical specifications of a machine, we invite you to contact us at info@gaspa-macchine.com. Our goal is to resolve every report quickly, transparently, and without resorting to formal procedures.
If it is not possible to reach a direct agreement, consumers residing in the European Union may use the European Commission's ODR platform, available at ec.europa.eu/consumers/odr, or the national alternative dispute resolution bodies of their country of residence, listed in our Warranty and Protection Policy (Section 11).
The sales contract is governed by Italian law, without prejudice to the fact that consumers residing in the European Union are in any case subject to the mandatory protection provisions provided by the legislation of the country of residence, where more favorable. For disputes not resolved alternatively, the competent court is that of the registered office of GASPA S.R.L MACCHINE (Court of Sassari), unless otherwise provided by exclusive jurisdiction in favor of the consumer's court by the law of the consumer's country of residence.
