The provisions contained on this page clearly and comprehensively describe the technical support services and maintenance guidelines that GASPA MACCHINE makes available to its buyers, precisely defining the responsibilities of the seller and those of the buyer. This policy complements, but does not replace, the Warranty and Protection Policy and the General Terms and Conditions of Sale.
Note: where the legislation of the buyer's country of residence provides for broader after-sales assistance rights than those indicated in this policy, the legal provisions most favorable to the consumer shall always prevail. GASPA MACCHINE fully complies with the consumer protection legislation of each country to which it ships.
GASPA MACCHINE is a dealership specializing in the sale of new and used agricultural and construction equipment. The categories of equipment to which this Maintenance and Support Policy applies include:
- Agricultural tractors (new and used) of various brands and engine sizes, intended for agricultural work, load handling, and open-field operations.
- Mini-excavators (new and used), used for excavation work, light demolition, and earthmoving in confined spaces.
- Earthmoving equipment (new and used), including wheeled loaders, tracked excavators, backhoe loaders, and similar machinery.
- Tandem rollers (new and used), intended for compaction of road surfaces and pavements.
- Telescopic handlers (telehandlers) (new and used), used for material handling on construction sites and in agricultural settings.
- Construction equipment and accessories sold in conjunction with primary machinery.
The equipment sold by GASPA MACCHINE may be new or used. In the case of used equipment, the state of wear, age, and operational history of the equipment directly affect reasonable maintenance expectations. Each piece of used equipment is sold with a listing that clearly indicates the year of manufacture, recorded operating hours, serial number, and declared condition at the time of sale. This information forms the contractual basis on which maintenance and support expectations are founded.
Used equipment – caution: used equipment may show ordinary wear, signs of intensive use, or previous maintenance interventions. The condition of the equipment is documented in the product listing and in the pre-delivery inspection report. The buyer is invited to carefully read the Declaration on Used Equipment Sold As-Is before proceeding with the purchase.
Each piece of equipment sold by GASPA MACCHINE is delivered with all technical documentation available at the time of sale. The completeness of the documentation depends on the type of equipment (new or used) and the year of manufacture.
- Operation and maintenance manual: provided, where available, in the original manufacturer's version. For used equipment manufactured before 2000, the availability of the original printed manual is not always guaranteed; in such cases, GASPA MACCHINE informs the buyer before the contract is concluded.
- Maintenance log and service history: provided when in possession of GASPA MACCHINE. Please refer to our dedicated page on Equipment Maintenance History and Documentation for complete information.
- CE conformity documentation: for equipment falling within the scope of Machinery Directive 2006/42/EC, a copy of the CE declaration of conformity is provided (where applicable and available for used equipment).
- Pre-delivery inspection report: an internal GASPA MACCHINE document certifying the condition of the equipment at the time of shipment, including any visible anomalies detected before delivery. For details, please refer to the page Equipment Testing and Pre-Delivery Inspection.
- Keys and starting devices: all original keys and remote controls available are included with delivery. If a duplicate is missing, this is noted in the product listing.
For equipment from brands such as JCB, Manitou, Komatsu, New Holland, Case IH, John Deere, Kubota, and other major manufacturers, technical and workshop manuals are often available on the manufacturer's official website or through specialized portals. Should the buyer require assistance in obtaining technical documentation for their equipment, they may contact our support service at info@gaspa-macchine.com and our team will do its best to provide useful guidance, although we cannot guarantee the availability of third-party documentation.
Pursuant to Art. 102 of Legislative Decree 206/2005 (Italian Consumer Code): the seller is required to provide the buyer with all information necessary for safe and correct use of the goods. GASPA MACCHINE fulfills this obligation by delivering, with each piece of equipment, all technical documentation in its possession and clearly indicating in the product listing any absence of original documentation.
Proper scheduled maintenance is an essential condition for preserving the functionality and safety of any agricultural or construction equipment. In accordance with machinery safety regulations in force in Italy (Legislative Decree 81/2008 – Consolidated Workplace Safety Act) and in other destination countries, the responsibility for routine and scheduled maintenance rests entirely with the buyer from the date of equipment delivery.
By way of example, and without claim to completeness, routine maintenance tasks that the buyer must perform include:
- Periodic inspection and replacement of oil, air, fuel, and hydraulic filters, according to the timelines indicated by the manufacturer in the maintenance manual.
- Replacement of engine oil and transmission oil at specified intervals (generally every 250–500 operating hours depending on the equipment).
- Checking and topping up coolant, hydraulic fluid, and brake fluid.
- Checking the tension and wear condition of tracks (for mini-excavators and tracked equipment).
- Inspection and inflation of tires (for wheeled equipment) according to the pressure values indicated by the manufacturer.
- Periodic lubrication of joints, articulations, connecting rods, and pins according to the manual's instructions.
- Verification of proper operation of lights, audible warning devices, safety devices, and braking systems before each use.
- Cleaning of the radiator and cooling ducts, particularly after use in dusty environments.
- Inspection and replacement of timing belts and wear-prone accessories at the intervals indicated by the manufacturer.
Failure to perform routine maintenance at the times and in the manner indicated by the manufacturer may result in exclusion from commercial warranty coverage (where applicable) for failures or anomalies directly attributable to maintenance negligence. However, pursuant to European consumer protection legislation (EU Directive 2019/771), the legal warranty of conformity cannot be unilaterally excluded by the seller without proof that the defect was caused by the buyer.
Important recommendation: the buyer is advised to retain all receipts, invoices, and records of routine maintenance performed (e.g., oil changes, filter replacements, etc.), both to prove proper use of the equipment in the event of a warranty claim and to maintain the commercial value of the equipment over time.
All maintenance work must be performed by qualified personnel, with the equipment turned off, on level ground, and with safety devices engaged. GASPA MACCHINE disclaims any liability for injury to persons or damage to property resulting from maintenance work performed without observing the safety standards indicated in the manufacturer's manual or the provisions of Legislative Decree 81/2008 (Italy) and equivalent regulations applicable in the country where the equipment is used.
GASPA MACCHINE is committed to offering its buyers professional and accessible after-sales technical support for the duration of the business relationship and beyond. Our goal is to ensure that every piece of equipment purchased from us continues to operate efficiently and safely for the useful life expected by the manufacturer.
- Telephone and email technical consultation: our team answers technical questions about the purchased equipment, correct interpretation of the operation manual, failure symptoms, and first-level diagnostic procedures.
- Assistance in defect assessment: in case of anomalies or malfunctions, our support service analyzes the buyer's report and provides a preliminary indication of the nature of the problem (failure covered by warranty, ordinary wear, operational error, etc.).
- Guidance to specialized workshops: for interventions requiring the physical presence of a qualified technician, GASPA MACCHINE can direct the buyer to technical service centers specializing in the brands of equipment sold (JCB, Manitou, New Holland, etc.), where available in the buyer's country.
- Support in warranty claim management: if the report falls within the conditions of the legal or commercial warranty, our team initiates the claim procedure according to the provisions of the Warranty and Protection Policy.
- Assistance in sourcing spare parts: upon request, GASPA MACCHINE can support the buyer in identifying and sourcing original or equivalent spare parts for their equipment, without committing to guarantee direct supply, except by specific agreement.
The technical support offered by GASPA MACCHINE is of a consultative and advisory nature. GASPA MACCHINE does not have its own network of traveling technicians for on-site interventions outside Sardinia. For buyers located in countries other than Italy, support is provided primarily remotely (telephone, email, video call by arrangement), and GASPA MACCHINE cannot guarantee the availability of a technician physically present at the buyer's location.
Support in available languages: GASPA MACCHINE's technical support service is available in Italian and, where possible, in English. For communications in other languages (French, German, Spanish, etc.), we recommend using email, which allows for a response assisted by translation tools to ensure maximum mutual understanding.

Urgent requests: in case of a failure that compromises the operational safety of the equipment (e.g., malfunction of the braking system, lifting system, or other primary safety devices), we recommend that you immediately suspend use of the equipment and contact us by phone without delay. Do not attempt to repair safety devices without the assistance of a qualified technician.
The availability of original spare parts is a determining factor for the long-term maintainability of any work equipment. GASPA MACCHINE operates as a dealer of new and used agricultural and construction equipment and does not directly manage an inventory of original spare parts. However, it offers a support and guidance service to facilitate the buyer in sourcing and procuring necessary components.
- Upon the buyer's request, GASPA MACCHINE can assist in identifying the original part number (OEM) of the required component, using the technical documentation of the equipment in its possession.
- For the major brands handled (JCB, Manitou, New Holland, Case, Komatsu, Kubota, John Deere, and similar), there are extensive networks of original and aftermarket spare parts distribution throughout Europe. GASPA MACCHINE can provide information on procurement channels available in the buyer's country.
- For equipment of particularly old manufacture or less common brands, the availability of original spare parts may be limited or require longer procurement times. In such cases, GASPA MACCHINE indicates this in advance in the equipment's product listing.
Should GASPA MACCHINE have or be able to procure the requested spare part, its supply is subject to a separate quotation that includes the cost of the component and any shipping costs to the buyer's country. The terms of return and refund for separately purchased spare parts are governed by the Returns and Refunds Policy of our store.
Recommendation for professional buyers: for equipment intended for intensive use, we recommend verifying the local availability of spare parts for the chosen brand and model before proceeding with the purchase, especially for destinations outside Italy. GASPA MACCHINE is available to provide, upon request, information on authorized service networks present in the main European countries to which it ships.
GASPA MACCHINE, as an independent dealer, does not manage its own network of authorized service centers throughout Europe. For technical interventions requiring the physical presence of a specialized mechanic, the buyer must rely on local technical service centers competent for the brand and model of the purchased equipment.
- Manufacturer's official service networks: the major manufacturers (JCB, Manitou, New Holland, Case, Komatsu, John Deere, Kubota, etc.) have networks of authorized dealers and service centers throughout Europe. Their official websites allow you to locate the nearest service center using the serial number or equipment model.
- Specialized mechanical workshops for agricultural and construction equipment: in the absence of an authorized service center for the brand in the immediate vicinity, a workshop specializing in agricultural or earthmoving equipment is capable of performing most routine maintenance and repair work.
- GASPA MACCHINE support for service center identification: our team can provide, upon request and without guarantee of completeness, information on the main technical service centers present in the countries to which we ship. This assistance is advisory and does not create any contractual relationship or liability on the part of GASPA MACCHINE toward the indicated service centers.
The costs of technical interventions performed by third-party workshops (labor, spare parts, travel) are entirely at the buyer's expense, unless the intervention is strictly necessary to remedy a defect covered by the legal or commercial warranty and has been previously authorized by GASPA MACCHINE. In the latter case, reimbursement of repair costs occurs according to the provisions of the Warranty and Protection Policy.
Mandatory prior authorization: any repair work performed by third parties that the buyer intends to charge to warranty coverage must be previously authorized in writing by GASPA MACCHINE. Work performed without prior authorization cannot be reimbursed, except in cases of documented proven urgency.

Transparency regarding costs is a fundamental principle of our commercial policy. Below we clearly indicate which support services are free and which may involve additional costs.
- Telephone and email technical consultation for questions regarding correct use, routine maintenance, and reading the manual of the purchased equipment.
- Preliminary assessment of failure or anomaly reports, aimed at determining whether the problem falls under warranty coverage.
- Assistance in warranty claim management, including communication with the authorized service center or carrier for equipment or component pickup, in cases where this is provided for by the warranty.
- Guidance in finding specialized workshops or spare parts distributors in the buyer's country.
- Repairs not covered by warranty: repairs for damage from improper use, ordinary wear, accidents, or external causes are not covered by warranty and are at the buyer's expense.
- Supply of spare parts: spare parts, where supplied directly by GASPA MACCHINE, are subject to separate invoicing under the terms agreed at the time of order.
- Equipment transport for inspection or repair: equipment transport costs to a repair center not covered by warranty are at the buyer's expense, unless otherwise agreed in writing.
- Extraordinary specialized technical consultation: any technical consultations requiring the intervention of an external expert (expert assessments, insurance evaluations, etc.) are not included in the standard support service and are quoted on a case-by-case basis.
No charges without quotation: GASPA MACCHINE never charges support or repair costs without having provided the buyer with a clear and detailed quotation and without having received explicit approval. There are no hidden costs in our after-sales service.
The following return and refund terms apply to purchases made from GASPA MACCHINE and are integrated with the provisions of the Returns and Refunds Policy of our store.
Private consumers who purchase equipment through the gaspa-macchine.com website have the right to exercise the right of withdrawal within 14 calendar days from the date of equipment delivery, pursuant to Art. 52 of Legislative Decree 206/2005 (Consumer Code) and EU Directive 2011/83/EU. Withdrawal must be communicated in writing to info@gaspa-macchine.com before the deadline expires. Except for defects or non-conformity, the costs of returning the equipment are borne by the buyer.
Once the withdrawal notice is received and, where applicable, the equipment is returned in unchanged condition from delivery, GASPA MACCHINE proceeds with the refund of the amount paid within 14 business days from receipt of the equipment or proof of return, whichever occurs first. The refund is made using the same payment method used for the purchase, unless otherwise agreed.
In cases where the buyer has incurred expenses for the repair of a defect covered by the legal warranty and such expense has been previously authorized by GASPA MACCHINE, reimbursement of documented expenses occurs within 14 business days from receipt of complete documentation (service invoice, proof of defect, written authorization from GASPA MACCHINE).

Exclusions from refund: repair expenses performed without prior written authorization from GASPA MACCHINE, damage caused by improper use or failure to perform routine maintenance, expenses for work performed by workshops not qualified for the equipment brand, and transport costs incurred for independent pickup of equipment from our premises are not refundable.
GASPA MACCHINE operates in compliance with current regulations on e-commerce, consumer protection, machinery safety, and personal data protection in all countries to which it ships. - Machinery Directive 2006/42/EC: establishes the essential health and safety requirements for machinery placed on the EU market. New machinery sold by GASPA MACCHINE falls within the scope of this directive. For used machinery, the responsibility for compliance lies with the purchaser for any modifications made after the original purchase.
- EU Directive 2019/771 (transposed in Italy by Legislative Decree 170/2021): establishes consumer rights regarding the legal guarantee of conformity for the sale of goods, applicable to all B2C sales made by GASPA MACCHINE to consumers residing in the EU.

Purchaser's Responsibility: GASPA MACCHINE supplies machinery that complies with the essential safety requirements established by the EU Machinery Directive. It is the sole responsibility of the purchaser to ensure that the machinery is used and maintained in compliance with the local regulations applicable in the country of use, including provisions regarding mandatory periodic inspections, operator qualifications, and equipment registration, where required.
In addition to the specific provisions of this maintenance and support policy, consumers residing in countries to which GASPA MACCHINE ships enjoy specific post-sale protection rights established by local regulations. Below are the main additional rights by country, with particular reference to post-sale assistance and maintainability of purchased goods.
In Italy, consumers are protected by Legislative Decree 206/2005 (Consumer Code), updated by Legislative Decree 170/2021, which guarantees a 2-year legal guarantee of conformity and a 14-day right of withdrawal. The purchaser has the right to receive complete information on maintenance procedures and available spare parts. In case of dispute, it is possible to contact recognized consumer associations (Codacons, Altroconsumo, etc.) or initiate a joint conciliation procedure at local chambers of commerce.

In France, in addition to the legal guarantee of conformity (garantie légale de conformité, Art. L217-1 et seq. of the Code de la Consommation), consumers benefit from the garantie des vices cachés (Art. 1641 et seq. of the Code Civil), which covers hidden defects that render the goods unsuitable for use or significantly diminish their value, even if such defects were not known to the seller. In Spain, Real Decreto Legislativo 1/2007 (TRLGDCU), amended in 2021, guarantees consumers a legal guarantee of 3 years for new goods and 2 years for used goods, with presumption of pre-existing defect for the first 2 years. Spanish consumers can use the Sistema Arbitral de Consumo for free or low-cost dispute resolution.
Switzerland is not an EU member; the legal guarantee for defects is governed by the Code of Obligations (CO), Art. 197–210, with a duration of 2 years from delivery. Swiss consumers can contact the Staatssekretariat für Wirtschaft (SECO) or consumer protection organizations such as Konsumentenforum kf for assistance and advice.

If it is not possible to reach a direct agreement, consumers residing in the European Union may use the following procedures:
- European ODR Platform: for online disputes, accessible at ec.europa.eu/consumers/odr.
- National ADR Bodies: each EU member country has accredited bodies for alternative consumer dispute resolution (for national references, see Section 13).
- Voluntary Mediation: through bodies accredited by the Italian Ministry of Justice, pursuant to Legislative Decree 28/2010, for disputes subject to Italian law.
For disputes not resolved through alternative means, the competent court is that of the registered office of GASPA S.R.L MACCHINE, namely the Court of Sassari, unless the law of the consumer's country of residence provides for exclusive jurisdiction in favor of the consumer's own court. Applicable Law: the sales contract is governed by Italian law, without prejudice to the fact that consumers residing in the EU are subject to the mandatory consumer protection provisions of their own country's legislation where more favorable than Italian law.
