Before initiating any formal procedure, please contact our team at info@gaspa-macchine.com, detailing the problem encountered, the order number, and the desired solution. GASPA MACCHINE undertakes to respond within 5 working days and to propose a fair and transparent solution.
If it is not possible to reach a direct agreement with GASPA MACCHINE, consumers have the right to use the following alternative dispute resolution procedures:
- European ODR Platform: for online disputes relating to cross-border purchases, accessible at ec.europa.eu/consumers/odr. The platform allows consumers to resolve disputes in a simple, fast, and free manner.
- Mediation pursuant to Legislative Decree 28/2010: voluntary civil and commercial mediation procedure managed by bodies accredited by the Italian Ministry of Justice.
- National ADR bodies: each country where GASPA MACCHINE delivers has accredited bodies for alternative consumer dispute resolution (see Section 10 for country-specific references).
- Joint conciliation: GASPA MACCHINE is available to participate in joint conciliation procedures with consumer associations recognized at national and European level.
For disputes that cannot be resolved amicably or alternatively, the territorially competent court is the Court of Sassari, the registered office of GASPA S.R.L MACCHINE, without prejudice to the following mandatory exceptions:
- Italian consumers: pursuant to Art. 66-bis of Legislative Decree 206/2005, the Italian consumer has the right to choose the court of their place of residence or domicile as the competent court for disputes with the seller.
- Consumers from other EU countries: pursuant to EU Regulation 1215/2012 (Brussels I bis), consumers residing in an EU country other than Italy may sue the seller before the court of their country of residence, or before the court of the country where the seller is based.
- Swiss consumers: jurisdiction is determined based on the Lugano Convention of 2007, which provides for provisions similar to those of the Brussels I bis Regulation for relations between the EU and Switzerland.
Sales contracts concluded through gaspa-macchine.com are governed by Italian law. However, pursuant to EU Regulation 593/2008 (Rome I), mandatory consumer protection provisions provided by the law of their country of residence always apply to consumers residing in the European Union, when these are more favorable than Italian law. Therefore, the choice of Italian law cannot deprive the European consumer of the mandatory rights guaranteed by their national law.
