Section 6 Bank Transfer

GASPA MACCHINE accepts payments via direct bank transfer (SEPA Credit Transfer for SEPA Area countries, or SWIFT international transfer for Switzerland). This method is particularly suitable for high-value purchases, which is typical for the agricultural and construction machinery sold by GASPA MACCHINE.

Payment procedure via bank transfer
  • Step 1 – Method selection During the checkout phase, select "Bank Transfer" as the payment method and complete the order procedure by clicking on "Place order".
  • Step 2 – Receipt of bank details After order confirmation, the buyer receives via email the complete bank details of GASPA S.R.L MACCHINE (IBAN, BIC/SWIFT, account holder, and reference to be indicated). The machine is temporarily reserved pending payment.
  • Step 3 – Execution of the transfer (within 3 business days) The buyer must make the transfer within 3 business days of receiving the bank details, mandatory indicating the order number in the payment reference. In case of non-payment within the deadline, the order will be automatically cancelled.
  • Step 4 – Credit and order processing The order is processed and the machine prepared for shipping only after the actual credit of the payment to the account of GASPA S.R.L MACCHINE, which generally occurs within 1–3 business days from the execution of the SEPA transfer, or within 2–5 days for international SWIFT transfers.
Important notes on bank transfer
  • Bank fees applied by the buyer's bank for the execution of the transfer (especially for international SWIFT transfers to Switzerland) are the sole responsibility of the buyer.
  • The buyer must indicate the full order number in the transfer reference to allow for correct identification of the payment. Payments without an identifying reference may result in delays in order processing.
  • GASPA MACCHINE is not responsible for bank credit times, which depend on the banking institutions involved and SEPA/SWIFT procedures.

SEPA Area: all EU countries to which GASPA MACCHINE ships fall within the SEPA Area (Single Euro Payments Area). SEPA transfers in Euro are free or low-cost and are generally credited within 1 business day. Switzerland partially adheres to the SEPA system; for transfers to or from Switzerland, SWIFT rules apply.

Fraudulent chargebacks: initiating chargeback procedures for purchases legitimately made and regularly delivered constitutes fraudulent behavior and may be subject to legal action by GASPA MACCHINE pursuant to current regulations.

Section 16 PSD2 Regulation and Strong Customer Authentication (SCA)

In accordance with EU Directive 2015/2366 (PSD2) on payment services, transposed in Italy by Legislative Decree 218/2017, and the Regulatory Technical Standards (RTS) issued by the European Banking Authority (EBA), since January 1, 2021, Strong Customer Authentication (SCA) has been mandatory for all electronic payments in the European Union.

What is Strong Customer Authentication (SCA)?

SCA is a process for verifying the identity of the payer that combines at least two of the following three elements:

  • Something you know (e.g., PIN, password).
  • Something you have (e.g., smartphone, physical token).
  • Something you are (e.g., fingerprint, facial recognition).
How it manifests during payment on GASPA MACCHINE
  • For Visa cards: the Visa Secure (3D Secure 2.0) system may request confirmation via your bank's app, an OTP code via SMS, or biometrics.
  • For Mastercard cards: the Mastercard Identity Check system may require additional authentication via the banking app.
  • For American Express cards: the SafeKey system may require additional verification.
  • For PayPal: PayPal independently manages SCA authentication within its own platform.
  • For bank transfers: authentication is managed directly by the buyer's bank through its own access system.

If additional authentication is requested during payment (e.g., a code sent via SMS, a push notification on the banking app), please complete this verification to finalize the payment. Failure to complete the SCA will result in the automatic rejection of the transaction by the banking system.

Section 17 Consumer Rights and Protections by Country of Residence

Regarding payments and electronic transactions, every country to which GASPA MACCHINE ships provides specific protections for consumers. The main applicable provisions regarding payments are listed below.

Italy

In Italy, electronic payments are governed by Legislative Decree 218/2017 (PSD2), by Bank of Italy Resolution no. 18/2020 on SCA technical regulatory standards, and by Legislative Decree 206/2005 (Consumer Code). Italian consumers have the right to a full refund in the event of an unauthorized transaction (within 13 months from the date of the charge) and may submit a complaint to the Arbitro Bancario Finanziario (ABF) for payment-related disputes.

Austria

In Austria, payment rights are governed by the Zahlungsdienstegesetz 2018 (ZaDiG 2018), which transposes PSD2. Consumers can contact the Finanzmarktaufsicht (FMA) to report violations or the Arbeiterkammer for consumer disputes related to payments.

France

In France, PSD2 is transposed into Ordonnance n. 2017-1252. Consumers have the right to a refund within 1 working day for unauthorized transactions. For payment disputes, they can contact the médiateur de l'Autorité de contrôle prudentiel et de résolution (ACPR).

Germany

In Germany, payment services are governed by the Zahlungsdiensteaufsichtsgesetz (ZAG) and the Bürgerliches Gesetzbuch (BGB), arts. 675c–676c. The consumer has the right to an immediate refund in the event of an unauthorized transaction. For disputes, the Bundesverband deutscher Banken – Ombudsstelle or the Schlichtungsstelle der Deutschen Bundesbank is available.

Netherlands

In the Netherlands, PSD2 is transposed into the Wet op het financieel toezicht (Wft). The supervisory authority is De Nederlandsche Bank (DNB). For payment-related disputes, consumers can contact Kifid (Klachteninstituut Financiële Dienstverlening).

Spain

In Spain, PSD2 is transposed into Real Decreto-Ley 19/2018. The Banco de España is the competent supervisory body. Consumers can submit complaints to the Servicio de Reclamaciones del Banco de España for disputes related to electronic payments.

Poland, Romania, and Finland

In countries that have transposed PSD2 (Poland: Ustawa o usługach płatniczych; Romania: Legea nr. 209/2019; Finland: Maksupalvelulaki), consumers benefit from the same fundamental rights regarding strong authentication, refunds for unauthorized transactions, and fee transparency provided at the European level.

Switzerland

Switzerland is not subject to PSD2. Electronic payments are governed by the Federal Act on Financial Services (FinSA) and the supervision of FINMA (Swiss Financial Market Supervisory Authority). Swiss consumers who encounter problems with payments can contact the Swiss Banking Ombudsman.

EU ODR Platform: for disputes related to online purchases — including those regarding payments — consumers residing in the European Union can access the European Commission's ODR platform: ec.europa.eu/consumers/odr. ODR contact address: info@gaspa-macchine.com.
